SGRO Prevails in 4th Circuit ERISA Litigation

Kearney, Esquire of Selzer Gurvitch Rabin and Obecny prevailed in an appeal before the United States Court of Appeals for the Fourth Circuit in a case involving the application of Section 413 of the Employee Retirement Income Security Act of 1974 ("ERISA"). The appellate court upheld a United States District Court judgment won by Mr. Kearney that the statute of limitations based upon "actual knowledge" required only knowledge of certain facts giving rise to a cause of action, regardless of whether the claimants were aware of all of the facts or that the cause of action, itself, existed.
